Terms of Service

These Terms of Service ("Terms") govern your access to and use of Arc Accuracy, a precision scoring platform for shooting competitions, operated by ArcDev Pty (Ltd), registration number pending, Republic of South Africa ("ArcDev", "we", "us", or "our").

By accessing or using Arc Accuracy you agree to be bound by these Terms. If you do not agree, you may not use the platform.

1. Acceptance of Terms

By creating an account or accessing the platform in any capacity, you confirm that you are at least 18 years of age, have read and understood these Terms, and have the legal authority to enter into a binding agreement with ArcDev.

2. Description of Service

Arc Accuracy is a web-based software platform that provides:

  • Competition creation and management for shooting events
  • Competitor registration, team assignment, and profile management
  • Real-time score entry, calculation, and submission
  • Results reporting, leaderboards, and PDF export
  • Administrator and range-officer tools

Access to the platform is granted on a subscription or licence basis as agreed between ArcDev and the relevant club, organisation, or event host ("Licensee").

3. User Accounts

3.1 You are responsible for maintaining the confidentiality of your account credentials. You must notify us immediately at [email protected] if you suspect unauthorised access to your account.

3.2 You may not share your account with any other person. Each user must have their own account.

3.3 ArcDev reserves the right to suspend or terminate any account that violates these Terms or is reasonably suspected of fraudulent activity.

4. Acceptable Use

You agree not to:

  • Use the platform to enter false, fraudulent, or manipulated scores
  • Attempt to access accounts, data, or systems you are not authorised to access
  • Reverse-engineer, decompile, or attempt to extract the source code of the platform
  • Resell, sublicence, or redistribute access to the platform without written consent from ArcDev
  • Use the platform in any manner that violates applicable South African law or regulation
  • Introduce malicious code, malware, or any disruptive content into the platform

5. Intellectual Property

5.1 Arc Accuracy, including its software, design, brand assets, algorithms, and all associated documentation, is the exclusive proprietary property of ArcDev Pty (Ltd). All rights reserved.

5.2 Nothing in these Terms grants you any ownership right, title, or interest in Arc Accuracy or its underlying technology.

5.3 You retain ownership of competition data, competitor records, and scoring data you enter into the platform. By using the platform you grant ArcDev a limited licence to store, process, and display that data solely to provide the service.

6. Data and Privacy

Your use of the platform is subject to our Privacy Policy, which is incorporated into these Terms by reference. We process personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA).

7. Availability and Uptime

7.1 ArcDev will make reasonable efforts to maintain platform availability, but does not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance where possible.

7.2 We are not liable for any loss arising from downtime, data loss, or service interruptions beyond our reasonable control.

8. Limitation of Liability

To the maximum extent permitted by applicable law, ArcDev shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Arc Accuracy. ArcDev's total aggregate liability shall not exceed the amount paid by you for the service in the twelve (12) months preceding the claim.

9. Modifications to the Service

ArcDev reserves the right to modify, suspend, or discontinue any feature or the entire platform at any time. Where material changes affect existing Licensees, reasonable notice will be provided.

10. Modifications to These Terms

We may update these Terms from time to time. Continued use of the platform after notification of changes constitutes acceptance of the revised Terms. The current version is always available at /terms-of-service.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.
